Reacting to the issue of govt order delinking NCCT from apex body NCUI, Governing Council member and senior advocate in the Supreme Court V P Singh said the govt cannot take over an NCUI’s entity just like that.
Hinting at the possibility of filing a writ in the matter either on Wednesday or on Thursday Singh said NCCT was created under the provisions of byelaws of National Cooperative Union of India (NCUI) and the govt has no power to effect a separation between the two.
“NCCT is an NCUI’s entity and it has to be so; we do not mind the govt running it but it cannot take it over, stated the lawyer who works as a crisis-manager whenever NCUI gets involved in legal disputes.
Talking about the central argument of the proposed Writ petition V P Singh said “the government has no power to take over NCCT which was created by the byelaws of NCUI.” He also said that though he is not preparing the writ, being the senior Advocate he would argue the case in the court.
Advocate Om Prakash is preparing a writ petition based on the provisions of the NCUI byelaws, Singh informed. V P Singh hoped that NCUI would be able to get a stay soon. “I think in next 10 days we would have a stay order in our hands”, he said to Indian Cooperative.
Meanwhile, former Chief Executive and an old hand at NCUI Bhagwati Prasad was also called to Delhi to join in legal consultations on the issue. Prasad stays in Lucknow.
It bears recall that the Governing Council meeting held in Bangalore last week assailed the govt move and authorized NCUI President Chandra Pal Singh Yadav and his team to formulate the strategy to checkmate the govt gambit. Camping in Delhi, Yadav is directing all efforts to seek a stay on the govt order.
“The first and foremost job is to file a writ petition and seek a stay; negotiations with the ministry may follow later”, is the line of action the current leadership is working on, said an insider.
Readers would recall that the whole issue has erupted as a result of a letter from the ministry delinking NCCT from NCUI. The letter was titled “Establishing National Council of Cooperative Training (NCCT) as an independent, Central and Professional entity-delinking from National Cooperative Union of India”.

The Members of NCUI( that is GC members including President enjoying here and there going to patna, going to Chennai, Going to Munar they are enjoying by NCCT cost There is no connection between ICM Directors and the Governing Council members. Even though they gone to Directors conference and they name sake attented and enjoying the hill resorts. What is the use of Directors Conference. they are simply going and enjoying at the institute cost and NCCT cost including ICMs Directors. they have discussed fruitful things. The NCCT Employees suffering for the last two years because of not getting 7th pay commission, Even the NCUI employees got it including arrears. Why the President and Governing Council members not initiated any measures for provide 7th pay. Where they gone. Now they are fighting for NCCT. First they have take measure or steps for provide 7th pay for NCCT employees. Later they can fight for NCCT
Why the NCCT employees keeping mum. They should fight for the NCCT and NCUIfor getting 7th pay and other grievences. without fighting they can not get it. why the NCUI employes paid. Every employee scared abt for the NCCT and NCUI. so that they exploiting the employees and they enjoying it. Hence right nowt the NCCT employees should fight against the NCCT and NCUI
