A public interest litigation (PIL) filed by one Dr R.D.Anand from Chandigarh has caused the 97th constitutional amendment dealing with cooperatives to be in the news.
As per the PIL the Chandigarh Administration has blithely been ignoring the democratic norms and appointing administrators to replace the democratically constituted management boards of scores of cooperative housing societies in the Union Territory.
In response to the PIL, the Punjab High Court has asked the Chandigarh Administration to take necessary steps to implement the relevant provisions of the aforesaid constitutional amendment and submit a compliance report soon.
According to Mr Anand, all the 128 cooperative housing societies functioning in Chandigarh are presently being interfered with by the Administration and the difficulties of residents of these housing societies are in consequence refusing to go away.
All the problems of residents could get solved if the Chandigarh Administration went ahead adopting the provisions of the 97th constitutional amendment, Mr. Anand averred.
Anand in his petition before the court has charged the UT administration with infraction of an order issued by the central govt. calling upon all Union Territories and states to amend their cooperative societies act latest by February 2013.
