The Sole Arbitrator Bimal Julka, appointed by the Central Registrar has given an Award in favour of Fishcofed Managing Director B.K Mishra but rules that the continuation of T Prasad Rao Dora as President is not tenable.
Readers would recall that last year the Central Registrar of Cooperative Societies had appointed Sole Arbitrator for the settlement of a complaint filed by one of the employees of Fishcopfed, A P Ansari against Mishra and its former President T Prasad Dora.
The award reads, “The extension of service of Shri Bimal Kumar Mishra, Managing Director after 30.06.2020, the date of superannuation is not illegal, non-est in law and further has statutory backing”.
Whereas, in regard to Dora, in his Award, the Sole Arbitrator said, “Continuation of Sh. T. Prasad Rao Dora as President after 06.07.2020 is void, as it falls out of the Statutory Rules governing the Federation. The decisions as taken by the Board of Directors chaired by Shri T. Prasad Rao Dora after he lost the chairmanship of the society which he represented in FISHCOPFED are not non-est in law.
He further complained that “Whether the presence of Sh. Bimal Kumar Mishra in the Board meeting having an agenda for reappointment or for appointment as in-charge MD affect the legality of such proceedings and whether the decision taken by the Board of Directors chaired by Shri T. Prasad Rao Dora after he lost the chairmanship of the society which he represented in FISHCOPFED are non-est in law”, according to Ansari’s complaint.
It is notable that the Ministry of Fisheries and NCDC have a share of 89 percent in Fishcopfed. The internal clashes between the board members of Fishcopfed are affecting its growth and the employees have not been getting their salary for the last seven months.
