The logjam besetting dairy cooperative giant Amul seems to stretch to infinity with the beleaguered Chairman Vipul Chaudhary, as expected, challenging before the division bench of the High Court the order of a single judge allowing implementation of no-confidence motion passed against him.
Chaudhary’s appeal came up before the division bench of Justice V M Sahai and K J Thakar. However, Justice Thakar recused himself from the case. Chief Justice Bhaskar Bhattacharya will now assign the matter to another bench.
On Monday, a High Court judge had allowed the Federation to implement the no-confidence motion passed against Chaudhary by 14 of the 18 directors after January 11.
In the wake of the Monday judgment preparation for the removal of GCMMF Chairman Vipul Chaudhary were set in motion. But the judgment also allowed him the option of appealing this decision before a division bench of the High Court and the highest court of the land.
The group within the GCMMF opposing Mr. Chaudhary charges that he has grossly mismanaged the affairs of the federation and his continuance at the helm would ruin the organization. There are about 30 lakh milk producers affiliated to the GCMMF and their future is at stake, Mr. Chaudhary’s critics warn.
The GCMMF had argued before the court that majority of members had supported the no-confidence motion against Chaudhary and hence it should be implemented while Chaudhary’s lawyers argued that there was no provision of passing a no-confidence motion against the chairman in the bye-laws of GCMMF, nor was there any in the Gujarat Cooperatives Society Act.
