I am having a 2bhk flat in Siolim Goa. The society is formed and registered here. We have 1bhk and 2bhk flats in our society. The 1bhk flats are more than 2bhk flats in the society so they want to charge monthly maintenance as per area of the flat. Since the services provided under this charge is same for all they should charge equally for all.
The Maharashtra byelaws clearly say it should be charged equally per flat.
Please advise what the GOA bye laws say regarding this?
If it says to be charged as per area of the flat than it is wrong and needs to be corrected as you don’t provide any extra benefit to the bigger flats to charge them more.
Please look into it and advise what needs to be done.

Answer to your question can be found by exercising your right under
GOA CS ACT as provided in Section 32 reproduced below.
S32. Rights of members to see books, etc.— (1) Every member shall be entitled to inspect, free of cost, at the society’s office during office hours, or at any time fixed for the purpose by the society, the bye-laws, the last three years audited annual financial statements, audit report and audit rectification report and those portions of the minutes of general meetings and Board meetings and books and records relevant to his transactions with the society.
(2) A society shall furnish to a member, on request in writing and on payment of such fees as may be specified in the bye-laws, a copy of any of the documents mentioned in the foregoing sub-section within one month from the date of payment of such fees.
?Society’s registered Bye-Laws do not belong to any State.They pertain to the concerned society which has registered them as its bye laws with the Registering Authority. Maintenance Charges are to be fixed in accordance with the provisions of bye laws of every CHS. As such one needs to go to Society Office and look in to the bye laws to find out if the charges fixed by the Society are as required to be fixed under the Bye Laws. ?
