THIS IS TO INQUIRE WHERE IN , RECENTLY MY MOTHER WHO WAS OWNING A FLAT , TRANSFERRED THE SAME TO MY NAME THRU GIFT DEED. WHEN THE GIFT DEED COPY WAS GIVEN TO THE SOCIETY FOR TRANSFER , THEY HAVE ASKED FOR AN NO OBJECTION CERTIFICATE . MY MOTHER HAS 4 KIDS, BUT I HAVE BEEN THE ONLY ONE SUPPORTING ALL HER NEEDS AND I HAVE BEEN PAYING THE SOCEITY DUES SINCE LAST 20 YEARS , THERE ARE NO DUES PENDING. AS SUCH SHE HAS WILLING TRANSFERRED THE SAME FLAT TO MY NAME. I HAVE PAID ALL CHARGES , STAMP DUTY ETC.
THE REASON BEING THAT MY OTHER SIBLINGS MAY RAISE AN OBJECTION. WHEN THE FLAT IS ALREADY GIVEN THRU GIFT DEED TO MY NAME, HOW CAN THE SOCIETY RAISE AN OBJECTION?
PLEASE CLARIFY , SO I CAN PROCEED FURTHER.

TWO Assumptions.
Your mother is still a member. You are in Maharashtra.
1.Give a notice of transfer in a prescribed form to the Secretary duly signed by your mother and your consent.Two forms are there. ask from Secretary or outside lawyers.
2.Get the flat registered in your name. now there is nominal cost of registration as stamp duty has been waived very recently for transfers with in family.
3.After registration with the certified copy of the gift deed and evidence of registration submit an application for transfer of membership. there after no NOC will be required.
4.If you do not hear with in 3 months you are a deemed member.
