When can we hold the elections to the Co-Op Soc Management Committee – in Mumbai ?

We understand that elections are to be held under the supervision of govt appointed Officer and no such person has been appointed as yet.

Sunder N Iyer in Mumbai, the Chairman of Greenfields B CHS is one of the few cooperators updated with the latest on Cooperative Societies.   ?

A large number of Committees of CHSs in Mumbai are pulling on with no clue. Some are holding elections facing challenges from within and get no help from Authorities either.

The outgoing dispensation had relied heavily on their Cooperative strengths only to get sadly beaten.

The SCEA STATE CO-OPERATIVE ELECTION AUTHORITY should have been functional mode w.e.f. 14 2 2013 but this position is still like an “empty” pot. EMPTY because 44 member Authority has been named only as an eye wash for the head was not identified.

On 20th December 2013 a one line amendment to MCS Act was passed in State  ASSEMBLY to extend the deadline of SCEA holding elections to Committees having tenure expired prior to 31 3 2013. They declared extension till 31 12 2014.

In case  Sunder N Iyer’s Committee tenure has completed 5 years after 1-04-2013 there is another provision in the MCS Act in Sub-Section (4) inserted in Section 166 w.e.f. 14.02.2013 itself. Please read this exract from this Sub-Section picked up verbatim:

“?the committees of which the elections become due after the 31st March 2013,shall continue till the elections to such societies are held under the provisions of this Act as amended by the said Act”

If Mr Iyer’s Committee has completed 5 year tenure (even though originally elected for 3 years under Bye Laws registered prior to 2001) expect a further extension beyond 31  12 14 may be through ordinance as 2 months are not enough to hold elections by new Government. ?
