What if 70% members agree and not the office-bearers?

Thank you very much for providing this useful service to cooperative members!!

I live in a housing society in Mumbai, Maharashtra with 11 members. The building is 30 years old and therefore many of the members would like to proceed with a redevelopment project. 8 out of 11 members would like to proceed. This puts us above the latest 70 percent vote requirement for redevelopment. Unfortunately, the current chairman, secretary and treasurer are the 3 members opposed to the redevelopment. What can be done to remove these office bearers and revote for a new committee so that we can smoothly proceed with the redevelopment process?

The Society (8 out of 11 members ) wants to redevelop the Building but three office bearers are not convinced. Neither Office bearers nor Committee can be removed by Members once they are elected. Is there a way out to execute the desire of 8 of 11 members?

These 8 members should submit a requisition for holding Special general body meeting to the Secretary with Agenda namely to discuss and decide the Strategy for Redevelopment of the Property of the Society. Send the Copy of the requisition to the Dy Registrar of your Ward. This should work. There is no need to remove office bearers if they do not agree wit the majority. They have to abide by majority decision reached following due process for the same.
