Is the AGM / SGM of a co-operative society is legal if the secretary and treasurer are absent & chairman presides over the meeting?
I C Naik
Once a proper notice of AGM/SGBM of Cooperative Society is issued, presence of office bearers is not a precondition for a valid meeting. In fact as per Proviso to Sub-Section (1) of Section 75 of the MCS Act 1960 (assuming the queriest is in Maharashtra) if the AGM is not called Registrar calls such meeting. Any member eligible to vote in the meeting can be elected Chairman to conduct the meeting.
Dear Sir, is it compulsory to invite Registrar for the election of the society panel (Chairman/Secretary/treasure)
