Tamil Nadu: Old scene, new law!

The Tamil Nadu govt passed an order in 2009 constituting a “Pricing Committee” for cooperative residential plots and commercial sites. Committee members are registrar of cooperative housing societies, deputy secretaries of finance and housing Dept.

Registrar of Co-op housing Society also directed that no cooperative housing plots could be sold without the price being fixed by the Committee.

I am a member of a housing society which is a self financed. We used to buy a land by collecting amount from among members, develop it and allot the plots to the members.

In 1999 similarly a land was purchased through willing members. During development work board has been dissolved and a new board was formed only now after 13 years. Meanwhile the above mentioned govt order was passed in 2009.

The question is do we have to pay the current price to be fixed by the Pricing Committee? We contributed the money, we worked for the development and why cannot we fix the price? Kindly guide us.

This is the Administrative Authority over land in the State and Cooperative Laws do not have a jurisdiction over it. This may have to be examined by Property Lawyers and not a Cooperative Society Advisors.
