We are an apartment registered in Karnataka under Resident Apartment Owners Association rules. We have a Bye Laws governed by the ‘Karnataka Owners Apartment Ownership Act 1972’. This is a 5 year old document created by the builder and given to the owners. In this document, it states that the Quorum for any General Meeting will be ‘the presence in person of a majority of Members’.
We have over 300 flats of which approx. 25% are unsold. It is impossible to get Quorum as stipulated in the Bye Laws.
In the last General Body Meeting, we approved the budget for the year and other important decisions were taken, and approved by 48 members that were present.
A member that was not present, when informed of the decisions taken in the aforesaid GBM, complained that the decision was not valid as we did not have ‘Quorum’.
What should we do?
