I wish to know the Article of Constitution and other Law under which the following situation can be considered violation. ..
Secretary and his 5 associates recently contested and won the election under common symbol to our cooperative housing society, and some members complained to the registrar that they had circulated their pamplets on Society’s letterhead with the forged signature of Elections Officer after striking off names of opponent contestants. Registrar however hasn’t replied. Those persons have since been involved in embezzlement of society’s funds as we have proven to DDR.
I shall be highly grateful to your kind advice.
I C Naik
For such Cases Constitution is not of help as you have to file a dispute under Section 91 of Cooperative Court as Election Disputes are referable to that Court under Rule 78 of The Maharashtra Co-operative Societies (Election to Committee) Rules, 2014.
78.Election disputes.—No election shall be called in question, except by an election petition presented to the Co-operative Court as laid down in section 91.
On this account Registrar kept quiet.
