I stay with my mom & Dad in flat which is registered on my brother name, he get transferred to another city for new job ,now society was telling us to pay CARE Taker Charges as actual person on whose name registration is done is not staying on premises.
I want to know if such charges are valid by society laws and what are legal options to proceed.

These matters are subject matter of bye laws of every housing society. So go to the Office of your Society and inspect (free of costs) your society bye laws. You will find Rates of NOC for flats Not Occupied by the Flat holder but by somebody else with prior written permission of the Committee and after becoming a Nominal Member by filing application therefore.
If you are unable to do this Second option is this:
Please let me know the date and number of registration of your housing society. Also tell me the date on which (in case if) the registered bye-laws were replaced by adopting the latest Model in Special General Body Meeting/Annual General Meeting. This is to ascertain which Model Bye Laws are registered by your housing society and are in force?
