I stay in Registered Corporative Housing Society at Andheri -(E), Mumbai.
In our society election was due in May 2015, Committee members says they have informed the Registrar about the same but till date not any response as come nor any authorised person to conduct the election as come.
My question is under such circumstances what should society do.
1. Can the society go ahead with the election
2. Can the panel auditor (who audits our accounts) conduct the election.
3. What if authorised person does not come.
4. What will be the term of the committee members whose termed got over in May 2015.
5. What if the Committee members have not followed the rules for the election.
6. Can the committee members extend they term since the authorised person had not come.

All your questions are answered by a new provision Sub-Section 4 in Section 166 of the Act reading as under:
Notwithstanding anything contained in this Act, as amended by the Maharashtra Co-operative Societies (Amendment) Act, 2013, but subject to the provisions of sub-section (15) of section 73CB, the committees of which the elections become due after the 31st March 2013,shall continue till the elections to such societies are held under the provisions of this Act as amended by the said Act.
Your Committee is in full power except that it can not hold elections.
