We at Neha Apt o-op Hsg Society Mumbai would like your suggestion with regards to following case.

We have a member who has been society Secretary for last 10 yrs(since 2005)

He had requested to the members of the society in General body meeting to lend him a common space which is under staircase which used to serve as our society office for a lump sum of Rs 75000/- and yearly maintenance of Rs 4000/-(it was not a sale agreement,does not have society share certificate)

Now a new committee has been formed and looking into his misdeeds and there are quiet a few.(including fraud in our accounts book and managements)

He has made deed of tenancy which does not mention a start date and end date.

The society members had given him on humanitarian grounds.

Now we would like to take back our society space .Please suggest a way.

The space was initially planned for a small library for kids and playing area of indoor games since the area is only 15Sq Mts.

We humbly request you suggest us way so that we could fight this injustice

HE IS AN ENCHROAHER TO SOCIETY PROPERTY. BREAK OPEN THE LOCK IF IT IS AND REMOVE THE BELONGINGS. WHAT DO YOU IF YOU CATCH A THIEF. IF PEOPLE’S TEMPERS ARE HIGH HE IS BEATEN OR ELSE HANDED OVER TO THE POLICE. THIS IS WHAT YOU HAVE TO DO. FILE AN FIR FOR TRESSPASS.
