I am resident of Virar (west) from Mumbai. There are few issues which I would like to clarify society laws.
I am living on 2nd floor flat in housing society and under my kitchen window there is an opening which was as per building drawing and this goes in the balcony of first floor. Since I time I purchased this flat the owner of 1st floor flat has closed this opening. Now, birds come on this window and their shit and it stinks a lot. This smell goes over in our kitchen which affects in our food. More to add, the owner of 1st floor flat was secretary and he has done alteration to his flat and closed his balcony with aluminum grills and made rooms of this balcony.
I want to object on this. I don’t think he has taken any permission for this. How can this be sorted. I want to get this opening opened. Also, if he sells this flat then it will remain as it is. Can I object this and put a stay on this. I won’t allow him to sell his flat with this opening closed.
The present society secretary has also covered his balcony and made room.What is the procedure to get this sorted?
Another person as treasure of society does commercial kind (segregation of clips) of work in his flat and then a vehicle comes pick this gunny bags.Does this considered as commercial.
There is seepage of water from my flat during monsoon, I had given application a year back and they have overlooked it. How can I get this fixed?

For 1 2 and 3 file RTI Application with Public Information Officer Vasai Virar Municipal Corporation asking for particulars of modifications by owner of these flats which have been approved and whether modifications made by them were applied for and approved and on what conditions?
For the Last one file a complaint to the District Consumer forum against the Society for deficiency in service. It is in expensive and no advocate is required.
