Query of Janardhan Jadhav

I am Janardhan Jadhav, owner of a flat on 6th floor in Namrata Satellite Housing Society, Pimple Saudagar, Pune.

The toilet in flat above on 7th floor is leaking & so has damaged my toilet celling & bedroom & hall walls. When I approach the flat owner above he is asking me to pay half cost for repairing his toilet floors but is not ready to pay me anything for the damages cost in my flat due to leakages.
I am ready to play the half of total cost required to repair leakage & fix damages in both flats.

Kindly suggest if:
1) Should not the owner above also pay me half the amount required to repair damages in my flat?
2) What are the legal options as owner above denies to pay me any cost.

Looking forward to your expert advice.

I C Naik

I cannot see how you can repair Toilet Leakage in a flat above. Nor do I see a logic in sharing half costs of Repair.

Many members have approached District Consumer Disputes Redressal Forum and got orders of Forum asking CHS to attend to Repair: You can appear yourself. No need to have an Advocate.
