Query of Govind Hubilkar

We are 32 members Tenant owned Housing Society in Pune, Maharashtra.

As per new law (97th Amendment) we need to follow elaborate procedure for election of new committee.

As per law we need to form MC of 11 members ( Gen-6, Women-2, SC/ST -1. OBC-1.  VJ/NT/SBC 1) if only six members are willing to be part of MC is it necessary to follow all the procedures for election. or we can select the new MC and communicate to Registrar and Election authority?

First strength  of the committee as you have understood is what the commissioner for Cooperation and the Registrar of cooperative societies has specified in model bye law 2014 as a recommendation,  it is not the law.Actual strength is to be followed as what is specified in your registered bye laws. so if you have adopted 2014 model then only it will apply, You apprehend that only six members are willing to act. For understanding the complications that can arise for not electing full strength committee  please read my post by control+click
