Goa Assistant Registrar of Co-op.Societies & joint post of PIO has taken subterfuge in the RTI template and Not only evaded but categorically refused to answer even those questions that do fall under the RTI Act and suggested I visit him in his office.
So I sent the same letter with small but relevant changes to him again, under the Non-RTI route. This second time he again asked me to attend his office for discussions.
But this would be mutually futile and frustrating if some basic Yes/No answers were not given by him in
writing, to proceed in the discussions.
Again, I believe he maybe guilty of repeated Dereliction of Duty. Is this True?
1) The Main question is the Bond requirement to be complied with by the Society Office bearers, failing which they are to be deemed as having vacated office and therefore having acted illegally detriment to the Society. And are guilty under Fraudulent conduct etc of the IPC & Cr.PC and various other Laws.
WHAT IS THE CIVIL & CRIMINAL PUNISHMENT ESPECIALLY IF THE SOCIETY’s 3 Assets (Fixed, Current & Soft) have suffered severe Loss, Damage & Destruction ?
1b) The Ast.Registrar is also legally obliged to prosecute these office bearers if they have failed to sign the Bond within 15 days of assuming Office and inform him accordingly?
Does their Failure to sign the Bond makes all Resolutions/Decisions by the Office bearers Null & Void?
1c) Thus, all money collected from members, banks etc., and also spent by the Society officials makes them legally obliged to return the Money to its’ individual members and the Society? Also can they be punished
with Penalties. Levies etc., besides Imprisonment for criminal & civil offences?
1d) What is the Punishment for Fraud and Misappropriation of Society Assets: Fixed, Current & Soft? Are both the Society Officials and the Ast.Registrar etc., punishable for Dereliction of Duty? What is the Punishment? Article 14 of the Indian Constitution guarantees equality before the Law so both must be punished.
1e) If you read my attached letters for you below, to the Ast.Registrar of Co-op.Societies GOA, the points are amplified along with additional points.

You will be better off after meeting the concerned officers. Your communication is too long and you have too many questions. Better you explain your questions in person. If they are ready to listen to you I will say that are quite reasonable.
