I am staying in a registered Housing society at Pune. My flat is on the fourth floor and has an exclusive lobby in front of my flat common lobby is connected to this lobby and leads to the stairs and lift. Lobby in front of my flat is not used as a common passage. I have been staying in the flat for last four years.
Society now has sent a notice to remove shoe rack from common area.
Can you please advise if I can defend my case?

If the lobby in front of your flat is not included in the approved building plan and your purchase contract with builder as attached to and part of your flat it is an open area for common use by all members. Your exclusive use is not permissible, so it is better not to fight for this.
