I need some advise from you regarding below mentioned situation:

Our neighbor is carrying out his house renovation. One of the contractor’s employees laid some paint buckets, brushes and rollers and was washing all these stuffs in front of our door in the floor corridor. I requested this particular guy to move all these stuffs and wash it in their house or wash it at some other place. Hearing this the Flat owner came burning in fire and tried to bog me down by saying that you cannot ask me what to do where and starting misbehaving with me and my mother. During this heated argument between us, he picked up a hammer like tool used for puncturing wall plaster and tried to hit me, but he didn’t. he did this 2 times during our argument to frighten me, but i didnt stop to answer his unethical behavior. and above that his contractor also started arguing with us.

The owner of the house is an active committee member in our society positioned as Executive Officer. I would like to know how and which type of legal action can i take against him or under MCS ACT. Would appreciate your valuable advise.

Corridor is a part of undivided Common area accessible to every member in uniform manner. Bye law 50 could help you request management to take action against the member.

40.(a) No member shall do or suffer anything to be done in his flat which may cause nuisance, annoyance or inconvenience to any of the members of the society or carry on practice which may be repugnant to the general decency or morals of the members of the society.

(b) It shall be competent for the Committee either sou-moto or on receipt of the complaint from any member, to take steps to stop all such practices referred to in the bye-law No. 52(a) forthwith.

If the Committee fails to take action you can file a police complaint.
