Query from Surendra Aggarwal

My co-operative housing society has not adopted new bye-laws . The term of earlier MC ended  in Aug- 2014 and they conducted elections in 2015 without any intimation that the new bye-laws are applicable. Are the elections valid?

Cooperative Election Processes are centralized at State Level under new State Cooperative Election Authority. This authority has to hold elections as per the Maharashtra Co-operative Societies (Election to Committee) Rules, 2014. It has no relation to  the Bye-Laws as it used to be till 12 2 2103.

When you say “They” conducted elections. If this they are internal people and not the onedeputed from S C E A then the old committee is continuing. One reason ia prosion of Sub-Section 4 of Section 166 which directed committees whose term expired after 31 3  2013 to remain in office till a new committee is elected by S C E A.
