I bought a resale bungalow in Kolkata which is registered under west Bengal cooperative society act 1983.  While buying the seller asked for NOC from society which was given by society. The property is mutated in the name of seller in KMC.

After this we had our registry done. Now the BOD says that they were to be made party at registry otherwise registry is not valid. And they are restricting our entry in the premises saying we can’t use the road, water and electricity as it belongs to cooperative till we obtain membership. While they are not receiving anything regarding membership. My question lies:-

  1. Is cooperative to be made party after NOC and KMC mutation obtained?
  2. Does not I have a share in common area which I can use till membership is obtained?
  3. What is my status quo in the intermittent period between membership submission and approval as they are of intension of harassing us?

I will highly obliged if you kindly help me with the following information.

File a membership application with the Registrar of cooperative societies. He will forward it to the Management Committee of the society. The society will have to consider it and give a written reply.
