Please give advice. In our society each flat has 1 parking. My problem is I have car in my friend’s name. Have I right to parking? Society say as per law car will be in my family members name is compulsory. Is this right?

Parking of member’s vehicles in the Society compound is governed by the Rules specified in the registered bye-laws of the concerned C H S as improvised vide resolution passed at the general body meeting of the members.

Answers to any doubts about Parking Management in CHS are to be resolved by carefully going through the relevant bye-laws and Resolution of general body meeting as aforesaid. There is no law applicable to parking management in Cooperative Housing Societies passed in any State. After going through the necessary documents as aforesaid, if any interpretation issue arises please e mail the Extracts of applicable bye-laws and of the resolution thereon. I will try to help you find answers to your questions.

    If you have flat in society then society can not refuse to park your car. Society can not ask for ownership papers from any members. No such provision mentioned in bylaws of society. Parking provision must be there in your approved plans. As a member you can fight with society for that if society may pass such resolution in anybody like committee or general body is illegal. You can challenge such illegal resolution in cooperative court. Thanks.
