This is here from Santacruz East Mumbai.

Our society MC has carried out internal repairs of member flats apart from ceiling and bathrooms and every member incurred different expenditure.

Society has not yet submitted individual flat expenses for member scrutiny and at the time of approval not listened to the suggestions that a fixed equal sum be allocated.

I had already incurred repairs to my flat at my own expense just before this decision was made and the society refused to reimburse the amount to me stating that they will bear the expenses in the future whenever repairs will arise.

I feel this is injustice to my rights as a member since I was denied immediate reimbursement.

Please advice appropriate action and redressal of the issue.

In such matters inexpensive and relatively speedier method is submit a letter of your claim with justification that any layman would also see a reason. This is a case of deficiency in service to member and unfair practice. Give 15 days time to refund. Send copy to the Dy Registrar. The Letter should with a stern warning that if this is not resolved with in given time you will be constrained to file a complaint in the District Consumer Court. You need not hire a lawyer, but go personally with copy of the letter and a request letter ordering the society to sort out the  matter as per the Court’s directions.
