I am the Chairman of Daya Niwas ‘B’ Wing CHS Ltd., Dadar and wish you to advice me on the following matter.
The term of the existing Managing Committee will end in August 2014. Do we have to inform the Dy Registrar about the election which will be held sometime in August 2014 and that too six (6) months in advance? The date of election is not fixed. Our society has 45 members.

Your question is answered by Sub-Section 4 of Section 166 reading as under:
“(4) Notwithstanding anything contained in this Act, as amended by the Maharashtra Co-operative Societies (Amendment) Act, 2013, but subject to the provisions of sub-section (15) of section 73CB, the committees of which the elections become due after the 31st March 2013,shall continue till the elections to such societies are held under the provisions of this Act as amended by the said Act.
Sub-Section 14 casts an obligation as under:
(14) The committee of every co-operative society shall, –
(a) inform the State Co-operative Election Authority about the expiry of its term of office at-least six months before the date of expiry of such term;
As as as SCEA is appointed and its address is announced, send the intimation as aforesaid.
