In the view of 97th Amendment to the Bye-laws of the CHS. I would like to know
1) if elections are due in Dec 2013 what is the new process.
2) we are a Society of only 28 members.
3) we have not yet adopted the revised Bye- Laws due to the ambiguity of the same being passed in the State Legislative assembly.
Please advise.

The Maharashtra Cooperative Societies (Amendment) Act 2013 has inserted Section 73CB in the M. C. S. Act 1960 providing for constitution of this authority and its functioning in detail 13 Sub-Sections. Sub-Section 14 casts an obligation on all cooperative societies to send an intimation of date of expiry of its committee, to the SCEA six months in advance.
By this rule you are already late, but you have an excuse. The SCEA not being in place inform the Dy Registrar about the date of expiry of the present committee’s tenure.
As required under Section 73CB(1) the State Government has issued the Election Rules called the Maharashtra Co-operative Societies Election to Committee Rules, 2013 (in short the Election Rules) as published in the Extraordinary Gazette on 20 8 2013 No C.S.R. No. 639/15 C dated 19 8 2013. The Election Rules 1-87 are divided in 12 Parts and has 17 Formats concerning elections. Steps required to be taken by a cooperative housing society of less than 100 members are listed out by me which you may have come across on www.indiancooperative.com
Remain in touch with Mumbai District Housing Federation (Phone 022 22660068) as it is expected that in about a month’s time, Model the Bye Laws 2013 could be printed by them for distribution to its members at cost on Demand.
