One of My friends gave me this Mail ID to contact you regarding my doubt.
My question is that a woman by name Pappaththal deposits Rs. 23,000/- in to a Palladam Farmer (Kissan) workers cooperative society- in Tamil we call as Palladam Vuzhavar paniyaalar kootturavy sangam. She Deposits Rs. 23,000/- for a period of One Year under the scheme of Short Term Deposit for 6.5 % interest per year. She declared her son as nominee and bank issued a Receipt for the said amount with all the details i.e., rate of interest and nominee etc.,. Mrs. PAPPAMMAL dies before 2 months of maturity the deposit.
After the completion of One year her nominee Mr. KANTHASWAMY goes to the said society and asks the deposit amount for which he produces the Original Receipt which was issued by the said society along with death certificate of her Mother Mrs. PAPPAMMAL.
The said society refuses to return the deposit the concerned and declared Nominee. The Said society asks Mr. KANTHASWAMY to get the No objection Certificate from other heirs. Kanthaswamy says that Her mother has declared his name only as nominee in the Original receipt, then why I should get the NOC from other heirs. (If My mother has mentioned others(Heirs- Name) then Society has right to bring out all the heirs to receive the deposit amount by giving NOC- But my mother has mentioned only My name as Nominee).
My doubt is why society refuses to give the deposit amount without the signature (No Objection Certificate) of other Heirs. Who are they ? What necessary to get the NOC ? Whe I should get the NOC when I am the Nominee which was mentioned in the Receipt and declared by MY Mother ? Please reply and clarify My Doubt.
Actually My Mother has deposited this amount in the year 2009. Once in 6 months I go to the society and ask the deposit, they refuse. Nearly 5 and half years have been completed. But the concerned society so far has not issued/sent any letter to me and other heirs regarding the deposit amount and NOC. Also the concerned society so far has not issued any information/notice through any magazine regarding the deposit. On what basis the society is keeping the deposit amount without informing to the concerned party?
