We are going to have election in our CHS shortly and present Secretary says that if our flat / shop is rented out then the owner of the flat / shop cannot file nomination for Managing Committee election.
Kindly clarify whether the new society election rules have such restriction for the owners. An urgent response will be highly appreciated as we are having the election on 28th Dec 2014.

Now interpretation of who can contest election to managing committee is not within the ambit of authority of the Secretary or Chairman. It is vested in State Cooperative Election Authority. So you file nomination and SCEA will not object it for no disqualification is prescribed if a shop is rented. If it was a residential flat and a member does not reside in society premises than yes, he cannot contest as provided in the Bye laws (if at all).
