R Suresh, Jalnidhi Coop Hsg Soc Ltd, Goregaon West,  Mumbai

I am a Chairman of a Cooperative Housing Society in Mumbai.  Our Society is 43 years old and hence there are no rules regarding parking.

There is one resident in the Society who has purchased a Flat from occupant whose name is registered as owner with the Society.

The Father of the occupant was the original owner, after the Father died, there was a dispute in family but the occupant sold the flat illegally to a third party.  The dispute is on going with Dy. Registrar office in Kandivili.

The dy. registrar has instructed the son that he cannot sell the flat until the dispute in the family is settled.

However the son has sold the flat illegally and now the new occupant (illegal buyer) is claiming that he should be given parking in the Society.

I C Naik

The Committee need not do anything. Continue the membership in the same name without any change. Let the member approach Registrar with his membership application. Await Registrar’s instructions. As far as parking is concerned do not allow anyone to use it except the member.
