I stay in a cooperative housing society at Borivali West, Mumbai.
The 5 year term of the managing committee expired on July 2013. The committee is continuing as a caretaker committee. However, the committee members have decided on redevelopment even after their term is over and have finalized the PMC, lawyer and the developer.
Can you please advise whether a caretaker committee can take redevelopment decisions?

Once the Committee’s tenure is extended under State Law the Committee is no different from a Committee in office after the tenure is over. The State did not do its duty under Constitution amendment but that need not stop working on societies. The Cooperation Department did issue a circular saying these are care taker committees but ignore this circular.
