The Nagpur bench of Bombay High Court imposed Rs 40,000 cost on Saoner MLA Sunil Kedar for misleading the court and also dismissed his application, says Times of India in a report.
A single-judge bench directed him to pay the amount among four respondents for alleged harassment caused to them due to his plea. These respondents are state secretary of cooperatives ministry, enquiry officer appointed by Maharashtra government to probe Nagpur District Central Co-Operative Bank (NDCCB) scam, divisional joint registrar in Nagpur, and NDCCB bank chairman.
The Congress MLA had moved an application to issue notices to two co-opted directors on NDCCB’s board – from NABARD and Nagpur-based District Deputy Registrar Cooperative Societies. He demanded inclusion of these two in the list of 27 accused, including all directors of bank, who were involved in alleged transactions made in purchase of government securities. About 13 charges were framed against 27 persons.
Omprakash Kambdi and others filed an intervention through counsel Shrirang Bhandarkar opposing Kedar’s prayers. They contended these two directors were nominated members and they had hardly any say in the management’s decisions.
The bench termed MLA’s application as “abuse of process of law” while flaying him for “wasting court’s time”.
