Justice N. Nagaresh ruled that the 2024 amendment introducing Section 28(2A) is irrational and arbitrary, failing to meet the requirements of Article 14 of the Indian Constitution, which ensures equality before the law.
The court found the restriction unjustifiable, emphasizing that the amendment does not hold up to constitutional standards for fairness and reasonableness.
