HC rules Writ against KCMPUL maintainable

The Calcutta High Court declared Kishan Cooperative Milk Producers’ Union Ltd (KCMPUL) a “state” under Article 12 of the Constitution, making writ petitions for constitutional violations maintainable against it, reports the Millennium Post.

Petitioners alleged KCMPUL violated Article 300A by withholding salaries, citing financial issues. The court emphasized KCMPUL’s unchanged status as an “authority” under Article 12.

A Single Bench dismissed their plea, but the Division Bench, referencing prior rulings, held KCMPUL’s pervasive state control under statutory governance justified writ jurisdiction under Article 226.
