Maharashtra co-operative department has rejected nearly 600 applications from societies for getting deemed conveyance as they failed to furnish occupancy certificate (OC). As per the cooperative department statistics, nearly 1,300 applications were received from societies for getting deemed conveyance. Of this 300 were rejected in the initial stages due to incomplete documentation, according to a report in Times of India.
Of the remaining 1,000 applications, over 850 were forwarded to the sub-registrar for further compliance. Of those, just 250 got clearance for deemed conveyance while the rest were rejected on the ground that these societies did not have the mandatory OC official sources said.
Thane Municipal Corporation authorities claim, nearly 75% of housing societies do not have OC. Societies not having OC will have to give up their hopes of getting deemed conveyance for the piece of plot on which their society stands.
As per the Maharashtra Ownership Flats Act, 2005, in cases where a developer fails to execute the conveyance in favour of a co-operative society, the latter can make an application for the same.
Deemed conveyance is an important document for a society. Without it, the society only has possession rights and not any kind of redevelopment or other commercial rights.
However, sources say housing department authorities are likely to issue a circular asking officials not to insists on OC for giving deemed conveyance.
