As the saying goes, justice delayed is justice denied’. Despite being overworked, the saying describes exactly what our judicial system has been.
Ten years on, Bombay High Court’s order in the case of govt securities scam in the Nagpur District Cooperative Bank has yet to be followed by the lower court. Even the framing of charges has not begun.
The judicial delay is posing a threat to the very existence of the bank. There are allegations that a former Congress MLA, then chairman of the bank had diverted Rs 150 crore into a highly dubious deal.
The accused being an influential politico is cynically using a plethora of judicial procedures to his advantage and delaying justice.
Legal experts say the case needs to be prepared for the prosecution and the higher judiciary has to ask the lower court to take up the case on a proirity basis. Otherwise, the accused will remain at large mocking the rule of law.
