The Maharashtra cooperative societies (Amendment) Act 2013 amended the MCS Act 1960 in a comprehensive manner as directed under new Part of the Constitution of India “IXB Cooperative Societies” vide 97th Constitutional Amendment Act 2011. Section 75 of the MCS Act 1960 laying down the mandatory Agenda for Annual General Meeting to be held once every year was substituted with a longer list of businesses every society is directed to transact. Item iv of Sub-Section 2 reads “declaration regarding date and conduct of its election of its committee, when due;”
This o phrase is quite weird one.
It is advisable to make a comprehensive statement about elections held last and also expiry date of the tenure of that Committee. Conduct of the election is not with in hands of the Committee as we all know several Committees are pooling on beyond expiry of the term as at present.
