I shall feel obliged if you can inform me whether —

[1] Can Housing society compel member to pay ‘Festival Fund’ of Rs 900 pm. This fund is being utilised by the society in arranging lunch/Dinner at various Festivals.  Light decoration etc.

[2] For how long period Hosing society can charge Non occupational charges ,whether it is only at a time when flat is let out on live & licence or still Tenant occupies flat  on live & license basis.

Number 1.

This is an un-healthy practice. Some CHS do collect small amounts like 100 or 150 which is also wrong. Bye laws provide an object of carrying out such activities but funds for such activities  are to be drawn from the welfare Fund to be established as provided under Bye Law No 148(b)(iv) Model 2014). Bye Laws do not provide for collection of welfare fund.

If there are other members who also have the same views as yours or above  I suggest all of you file a dispute before Cooperative Court as Group with CHS as provided under Bye law 174(b)(i).

You have to take prior permission of the Registrar before filing a dispute.

Number 2

NOC is payable as long as instead of member occupying the flat himself let others occupy.
