The committee of society could not get the election conducted before the expiry of term.
The registrar cooperative societies took over the charge of societies after dissolving the committee.
Is there any liability of the committee members for not getting the elections conducted before expiry of the term.
I C Naik
Now that the cooperative elections are centralized under the State level Cooperative Election body SCEA headed by Chief Commissioner every Society’s current committee is made responsible to inform the W C E O ward cooperative election officer by submitting a report in Form E 2 prescribed under the Maharashtra Cooperative (election to committees) Rules 2014 at least 6 months before the date of expiry of the tenure of the Committee. If the committee fails io communicate on expiry the Committee vacates the office and Authorised Person a new nomenclature of now banned Administrator (in CHS) is sent by the Dy Registrar to run the CHS and organise elections with SCEA. He has maximm of six months to do this. If after six months also no elections are held law is silent and probably AP will stick to the job though illegally. Section 73CB(14),73I(2) and 77A provide for this.
