Letting out flat to another member

Hello Sir

I am member of cooperative housing society in Kalyan, Thane District for last 10 years. Currently, I am working overseas and hence intent to give my flat on leave & license basis for 11 months to another bona fide member of same society.

Pl provide your expert advice on following –

1.Do I need to provide intimation to society? How much time?

2.DO I need to obtain written permission from society?

3.What are non-occupancy charges payable under rules?

Our society has adopted general body resolution couple of years back, wherein they charge two times of normal maintenance charge.

ANSWERS TO THESE QUESTIONS ARE IN registered bye laws of your society. Depending on bye law Model used to register you will find exact number. Normally prior approval of MC is required for renting out a flat, tenant must sign LL agreement of 11 months and it is to be registered by a Power of Attorney holder on your behalf. NOC is excessive as per what you say. It is 10% of maintenance bill excluding Taxes.
