In a major bid to revamp the cooperative movement in West Bengal , the Mamta government has amended the West Bengal cooperative societies act,2006.
The amendment was long overdue as the cooperative sector in the state had almost grounded to a halt.The state assembly has passed the amended act.
According to the state cooperative minister H A Safwi, the amended act would bring about great changes as it would ensure democratic elections in the cooperative societies and insurance of the cooperative banks.
The new act provided for cooperative service commission and cooperative election commission. The minister hoped that the amended act would usher in a new era of development in the cooperative sector in the state.

I would like to know the future of Cooperative Service Commission recommended staff to Calcutta Wholesale Consumer’s Cooperative Society Ltd where Sate government share participation is above 80%.The society is in sick.We get 4000/- p.m with insecurity of service. Yet cooperative service commission is treated on par with public service commission. For this we applied and appeared for tough competitive examination. As per status of commission we do not get salary and recognition. We are at stake. Cooperative service commission is not cooperating with us. West Bengal cooperative minister should take initiative .Otherwise we shall have no option but to commit suicide.

Our salary is from TE 4000-/-p.m to TE 6000/-.After 30 years manager of this concern is getting Rs 7000/ p.m. Whereas the group D staff of state government are drawing Rs10,000/ p.m .The clerkship examination of PSC is like that of WB Cooperative Service Commission.Yet we are not getting at least salary of Group D staff of state government . Our status is grocery worker.Being educated and selected through tough competitive examination in West Bengal we are in status of grocery worker. The society may wind up at any time because it is in loss for several years . It is not possible for the society to give us salary by retail selling rice, dal, mustard oil etc .We demand immediate withdrawal of our service from here to Cooperative sectors attached to state government,Cooperation department in Writer’s building, local cooperative Bank as per our address & reservation in state government service, age relaxation in any government service.There is no environment of work in this society . New Government takes a positive initiative for amendment related with cooperative sector, but this might have not fulfill the demand of cooperative sector.
I am an employee of a Nadia District Central Cooperative Bank.I realse
the necessity of Professional Management in the Board as well as administration of the Bank,
Cooperative structure has solid base but without professional management
it will not get due momentum.We also recomend that minimum qualification
of a director at central or state cooperative level should be graduate.

It is high time for Cooperative Service Commission recommended staff appointed to various cooperative Bank and cooperative societies that we should be united to execute the status of commission from present Government.In case a society winds up where Cooperative Service Commission recommended staff appointed , our duty is to stand by the them.It should be noted that we have been selected by A government Body . On the permission of Registrar of Cooperative societies , Cooperative Service Commission has recommended us in various cooperative sectors. So, we should be transferred to another cooperative bank or cooperative societies if any society winds up and if the society cannot maintain the present pay of government.

At present the Minister In Charge is Shri Haider Aziz Safwi. The Secretary, Shri Sayeed Ahmed Baba, IAS, is the Head of the Department and he is assisted by a number of officers of the rank of Joint Secretary, Deputy Secretary, Assistant Secretary and other officers and staff in order to carry out the main duties and functions which are as follows;

To formulate and implement National and State Policies and Programmes for achieving rapid growth and development in order to usher in economic and social change in the lives of the rural and urban population by extensive use of principles of Co-operation.

To undertake developmental planning for the Co-operative Sector of the State.

To formulate Policies relating to Co-operation and co-operative organisations, Co-operative training and education.

To strengthen the Co-operative movement through the participation of National Co-operative Development Corporation (NCDC), National Agricultural Co-operative Marketing Federation of India Limited (NAFED), National Co-operative Consumer Federation of India Ltd. (NCCF) and National Co-operative Union of India (NCUI).

To bring about integrated development of marketing of agricultural produces and to safeguard the economic interests of the farming community in general and to control the prices of commodities by ensuring extensive participation of co-operatives.

To supplement the efforts of State Governments for increasing the production and productivity of agricultural and horticultural crops as well as to create a strong storage infrastructure in the rural areas by bringing all the districts under the purview of development schemes like ICDP, RKVY, RIDF etc.

To interact and hold meetings and discussions with national institutions like RBI, NABARD, NCDC, NHB etc. and State Government Departments like Finance, Agriculture, Panchayat & Rural Development, Animal Resources Development, Fisheries, MSE & Textiles, SHG & Self-Employment, BCW etc. for ensuring financial help and infrastructure development in the Co-operative Sector

Exercise the powers and perform the duties as per the Co-operative Societies Act and the Rules for development, supervision and regulation of the Co-operative Societies in the State in the following manner;

Appoint the Registrar of Co-operative Societies and members of his team to apply the different provisions of the Act and the Rules for promotion and organizing the Co-operatives as well as to supervise and regulate their activities
o
Appoint the Director of Co-operative Audit and his team members for carrying out the audit and all related matters in relation to the registered Co-operative Societies.
o
Constitute and appoint the members of the West Bengal Co-operative Tribunal, Registration Council and Co-operative Service Commission
o
Exempt any Co-operative Society or Class of Co-operative Societies from the application of the provisions of the Act or Rules.
o
Direct application of the provisions of the Act or Rules to any Co-operative Society or Class of Co-operative Societies
o
Prescribe the extent to which a Co-operative Society shall limit the number of its members.
o
Order amalgamation of any central Co-operative bank with any other central Co-operative bank or with the State Co-operative Bank.
o
Permit the Registrar to call the General meeting even after the expiry of fifteen months from the date of the last preceding meeting.
o
Depute Government Officers to manage the affairs of the Co-operative Societies.
o
Order immediate dissolution of the Board of Directors and appoint Administrator either on recommendation of Registrar or on own motion of the Department.
o
Rescind or suspend any proceeding or resolution of any General meeting of a Co-operative society or of the Board thereof under certain circumstances.
o
Nominate on the Board of a State aided Co-operative Society not more than three members or one- third of the total number of elected members of the board whichever is less.
o
By Notification provide for reservation of not more than one-fifth of the seats on the board of a Co-operative society for socially, economically or educationally backward community, class or group of persons.
o
Authorize a co-operative society to receive loans by issue or re-issue of debentures.
o
Grant approval to a co-operative credit society to borrow money by issue of bonds.
o
Grant financial assistance to Co-operative societies.
o
Issue directives to any Co-operative society or class of Co-operative societies to modify its policies or to take actions in the manner as may be specified in the order.
o
Remit duties, fees, tax or cess and grant preference and exemption to any Co-operative society or class of Co-operative societies.
o
Grant approval by general or special order to any association or body of persons (whether incorporated or not) or any financing bank to be eligible for membership of a co-operative society.
o
Extend by Notification, the provision of direct membership similar to one provided for primary Co-operative credit society and farmers’ service co-operative society to such other Co-operative society
o
Order conducting of cost audit or performance audit or both of a society or class of societies.
o
Authorize inspection of any co-operative society.
o
Extend time limit for disposal of appeals by the appellate authority (other than Co-operative Tribunal).
o
Call for and examine the records of any inspection or enquiry held or the proceedings of the Registrar or any person subordinate to him or acting on the authority of Registrar and pass appropriate orders.
o
Add to and amend the Fifth schedule list of the Act.
o
Frame Rules for carrying out the purposes of the Act.
o
Hear and dispose of appeals arising out of orders of apportionment of cost of inspection or inquiry made by Registrar.

Hear and dispose of appeals arising out of orders of approval of expulsion of members from housing Co-operative societies accorded by Registrar.

The State Government has constituted the West Bengal Co-operative Service Commission which has been entrusted with the task of selecting persons for appointment to certain posts other than Group-D posts in all the Apex Co-operative Institutions including the State Co-operative Bank and the State Co-operative Agriculture and Rural Development Bank, Central Co-operative Banks and other Central Societies, Primary Co-operative Agriculture and Rural Development Banks and Primary Urban Co-operative Banks.
The Commission is headed by a person who has been or is a Judge of Calcutta High Court or a person who holds or has held a post not below the rank of a Secretary to the Government of West Bengal. The commission also has two other members who are persons from the apex societies appointed by state government. An Officer of the rank of Additional Registrar of Co-operative Societies appointed as Secretary of the Commission for conducting its business and affairs.

The Commission has also been provided with the services of officers of the rank of Deputy Registrar of Co-operative Societies and Assistant Registrar of Co-operative Societies who function as its Deputy Secretary and Assistant Secretary respectively. A number of officers of the rank of Co-operative Development Officer and Inspector of Co-operative Societies have also been deputed by State Government to the service of the Commission who, along with clerical and Group D staff, carry out its regular business. The State provides with financial as well as the logistical support and the Commission is treated on par with the State Public Service Commission in status and position. The State Government has the power to increase or decrease the staff strength in consultation with the Chairman of the Commission.
The Selection Committee of the Commission consists of the Chairman and other two members of the Commission, a representative of the State-level or District-level Co-operative Society as the case may be and a representative of the Co-operative Society for which the selection is to be made. In case of selection of employees for a State Level Co-operative Society, the Selection Committee consists of the Chairman and two other members of the Commission, a representative of the State Level Co-operative Society for which the selection of employees is to be made and one officer of the Co-operation Directorate to be nominated by Registrar of Co-operative Societies, West Bengal.
Every Co-operative Society has to consult the Commission on all disciplinary matters affecting any of its employees appointed on the recommendation of the Commission and on such matters as may be specified by the State Government by Notification.

My impression is Governments in W B have not found Union Government’s Policies in the interest of the State by an large. This feeling is getting rewampled with the present Government. Concept of Federalism seems to be interpreted to mean comple freedom to State. But when it comes to giving freedom to Cooperatives as advocated by the Constitution itself, in the State, the WB Government has different yard stick. If winding up of the Cooperative Commission is on the cards staff have to think of “What Next”? For a Cooperative having 80% ownership of the State, its staff is no inferirir to State Government employees.

Dear Sir, Jalvayu Vihar coop society is a confused lot, whether the tenutre of BOD elected under sub section (8)of section 27 of the WB Coop society act 1983 and stand dissolved after three years of election should be desolved ,as more than three years have passed since election..They want to continue for five years as per their legal advise.What must be done after the notification271 coop/H/2R-11(pt 11) dt 6.2.2012

I am from Jalavayu Vihar Coop Housing society, Salt Lake.Our Board of directors were elected four years back as per Act 1983. As per act 2006, the tenure of Board of directors are for five years.On asking clarification from DRCS, no reply received to the effect whether the BOD will continue for five years.As per ammendment of 2006 act,our BOD should have arrenged fresh election after the tenure of three years as they were elected as per Act 1983.Now the BOD doesnot know what to do. As per new ammendment, they have no power to act.They should ask for a fresh election now. But who will tell them?

It is really a matter of pity of your conditions. But this is all due to the power politics that has erupted all over India. Maximun number of politicians come from cooperative sector, but as they are establised, they use cooperative as a tool to enhance their political aspirations. But this is a concerning matter for cooperators too as we have failed to put us toggether as a reckoning force. We in fact are being used for the survival by the politicians. The plans are made by the government, the aids are being given by the government but what have we done for our existance. We prefer to be slaves of the politics rather than strenghten cooperative movement. I wish u all the best and urge to stand up and fight for your cause, and let you be slaves of the principles of cooperative not politics.

Dear Benu Ji, i don,t know much about your act and haven’t either read it. But rest assured, if the act 2006 is implimented and the tenure is for fice years, they will have to quit after five years. Now that they have been elected four years back, that might be in 2007, so they will have to quit in 2012, rather they would be deemed as infructuous. All the decisions taken by them after that could be termed as illegal. By the way is there any provison in the act-2006, as the outgoing board will have to initiate election process, any speicfic days before their term ends?? I think if it is so, you need no more eleboration.

@ Mr. Ishwer Naik: I have been a participant in the activities of The Bengal Secretariat Co-operative Land Mortgage Bank and Housing Society Ltd, Kolkata – 700 068, which incidentally is the oldest surviving cooperatives in West Bengal and it is a multipurpose Society without ant involvement of the State Government. The Board of Directors got elected in 2008 and it is my earnest request if you could enlighten us with the status of the present board in light of the latest amendment of the West Bengal Cooperative Societies Act,2006 by Govt. of West Bengal. Further, does this amendment needs an assent from the President of India before it is finally implemented – Regards…

In continuation from my earlier comments on our Jal Vayu Vihar Coop Housing Society, Salt lake, I am sorry to mention that the DRCS has asked our board of diredtors to carry on activities till rep of DRCS will come for fresh election.How can an unautorised board of directors are asked to continue for years?Is there no concern about the new act by the authorities?

I am interested to purchase a flat in one of co-operative societies housing complex but my Lawyer advised me not purchase as 50% of primary members have already sold their flats of that particular society. Is this Rule getting amended ? Kindly throw some light in this respect.

I would like to know whether an agenda in “bigata sabhar siddhanta smuher anumodan” could be taken ( notice that : not to read or review the resolutions) in the next A G / Meeting of a co- operative credit society held after, generally, one year?!! Will the minute books ( resolutions) not be read and signed, by the chairman of the meeting, before the members gathered in a meeting, before completion the meeting? After 3 days!!! Will there be the transparency ? Please explain in details and inform its.

The Calcutta High Court today declared as unconstitutional an amendment brought by the West Bengal government to a section of the West Bengal Cooperative Societies Act, 2010. Justice B Somadder declared the amendment to section 36 of the Act, vide which the tenure of the boards of cooperative banks and societies in the state were reduced from 60 months to 36 months, as unconstitutional. Boards of several cooperative banks and societies were dissolved citing the amendment. The government had earlier this year amended section 36 of the Act, reducing the tenure of the boards of the cooperatives.

RBI is a status quoist institution, it will never supersede the board of District Cooperative Central Banks. DCCBs abound in mismanagement and corruption. They got lot of money under ADWDRS 2008 and STCCS reform package, and all has been ill spent. It is learnt that RBI officials inspected Vijaynagaram DCCB, Andhra Pradesh in Dec 2011under statutory provisions of B R Act for the financial position ending as on 31.03.2011 and found lot of irregularities. But they did not act in their recommendations to GOI or State Govt, which would have been mandatory. It appears that no one is above doubt.

As reported in The Telegraph – Calcutta – On 04.02.2013, the Bengal government promulgated an ordinance disbanding the elected boards in 2,000-odd co-operative societies that will be headed by government-appointed special officers till fresh polls. The West Bengal Co-operative Societies (Amendment and Validation) Ordinance, 2013, supersedes a Calcutta High Court order that had scrapped the state government’s earlier efforts to prune the tenure of the boards from five to three years.The timing of the ordinance is significant as the state is headed towards rural polls in which the boards of the co-operative societies are expected to play a critical role because of their clout in villages. As 90 per cent of the disbanded boards were under Left control, it is clear that the ordinance has been brought with a political motive. The ordinance had been kept under wraps till the last moment. Sources said that the government had been clearing the decks for the ordinance for some time since its attempt to bring an amendment drew a blank following a legal challenge in the high court. The court had termed the amendment, which sought to reduce the tenure from five to three years, “invalid, unconstitutional and ultra vires”.
